Dezember 2015              1621\nEmbassy                                                         Yangon, 06 December 2013\nof the Federal Republic of Germany\nYangon\nNote Verbale\nThe Embassy of the Federal Republic of Germany presents its compliments to the Min-\nistry of Foreign Affairs of the Republic of the Union of Myanmar and has the honour to\ncommunicate the following:\nWith reference to the Memorandum of Understanding between the Republic of the\nUnion of Myanmar Federation of Chambers of Commerce and Industry (UMFCCI) and the\nAssociation of German Chambers of Commerce and Industry (DIHK – Deutscher Indus-\ntrie- und Handelskammertag e. V.) of 2 May 2013 about the establishment of a Delegation\nof German Industry and Commerce in Yangon, the Federal Government would like to pro-\npose an exchange of Notes with the text mentioned below.\nThe Embassy would appreciate a confirmation that the competent Ministry for the reg-\nistration of the Delegation of German Industry and Commerce is the Ministry of National\nPlanning and Economic Development, as explained by H.E. Union Minister U Soe Thane\nduring a discussion of the issue on November 13, 2013.\nThe Federal Government would appreciate if the exchange of Notes could take place\nduring the visit of H.E. the President of the Federal Republic of Germany, on 10 February\n2014 in Nay Pyi Taw.\nEnglish language version\n“The Embassy of the Federal Republic of Germany presents its compliments to the\nMinistry of Foreign Affairs of the Republic of the Union of Myanmar and, in conformity with\nthe good relations between the two countries and intending to promote the economic re-\nlations and in particular cooperation in the field of trade and industry between the two\ncountries, above all in the area of small and medium-sized industries, has the honour to\npropose that an Arrangement between the Government of the Federal Republic of Ger-\nmany and the Government of the Republic of the Union of Myanmar concerning the es-\ntablishment of a Delegation of German Industry and Commerce in Yangon be concluded,\nto read as follows:\n1. With the aim of supporting economic cooperation between the two countries as stat-\ned above, the Government of the Federal Republic of Germany proposes to the Gov-\nernment of the Republic of the Union of Myanmar the establishment of a Delegation\nof German Industry and Commerce in Yangon (hereinafter referred to as “the Dele-\ngation”), in accordance with the law of Myanmar. The Government of the Republic of\nthe Union of Myanmar has agreed to the proposal of the Government of the Federal\nRepublic of Germany. The Delegation shall be a representation of the German Asso-\nciation of Chambers of Industry and Commerce (DIHK). Its official name shall be the\n“Delegation of German Industry and Commerce”.\n2. The purpose of the Delegation is to promote trade and economic relations between\ncompanies, organisations and tradespersons from the Republic of the Union of Myan-\nmar and the Federal Republic of Germany. It shall lobby in the interests of businesses\nfrom both countries and promote commercial activity in both directions. The Delega-\ntion shall pursue no profit-oriented objectives. The Delegation shall be financed by al-\nlocations from the Federal Ministry of Economics, grants from the DIHK, donations\nand other revenue permitted by the laws applicable in Myanmar. It is entitled to charge\nfees for its services to recoup its costs.\n3. The Delegation shall be registered with the competent agency of the Republic of the\nUnion of Myanmar. The Delegation shall be located in Yangon. It may, in accordance\nwith the law applicable in Myanmar, establish and maintain other branch offices in\nthe territory of the Republic of the Union of Myanmar.\n4.    The Delegation shall receive financial support for its work in the field of external eco-\nnomic promotion from the Federal Ministry of Economics and Technology and the\nDIHK. Payments made directly or indirectly by the Federal Republic of Germany and\nthe DIHK to the Delegation for the purpose of covering costs shall be exempt from\ndirect taxes in the Republic of the Union of Myanmar. The Delegation is permitted to\nhave bank accounts in the Republic of the Union of Myanmar and in the Federal Re-\npublic of Germany. Federal allocations disbursed via the DIHK to maintain the Dele-\ngation may be transferred at any time, freely and without restrictions, to the Delega-\ntion’s bank accounts in the Republic of the Union of Myanmar at the official exchange\nrate.\n5. Persons working for the Delegation in coordination with or on behalf of the DIHK for\nthe purposes specified in paragraph 2 above and their family members (spouse/reg-\nistered partner and their children who are minors or are undergoing training) are not\nmembers of the diplomatic missions or consular posts of the Federal Republic of Ger-","1622 Bundesgesetzblatt Jahrgang 2015 Teil II Nr. 34, ausgegeben zu Bonn am 18. Dezember 2015\nmany in the Republic of the Union of Myanmar. They do not enjoy the privileges and\nimmunities granted to the staff of such missions and posts.\n6. The competent authorities of the Republic of the Union of Myanmar shall issue resi-\ndence permits to the persons specified in paragraph 5 above expeditiously within the\nscope of the applicable laws and regulations. The residence permits shall entitle the\nbearer to multiple entries and exits for the duration of their validity. In accordance with\nnational law, the permits shall be issued the first time for a maximum period of five\nyears and may be extended thereafter. A residence permit in the form of a visa must\nbe obtained from a diplomatic mission or career consular post of the Republic of the\nUnion of Myanmar before leaving Germany. Applications to extend the permit’s va-\nlidity may be filed in Myanmar.\n7. The persons specified in paragraph 5 above do not require work permits to perform\ntheir activities at the Delegation.\n8. The Delegation shall employ an appropriate number of staff to fulfil the purpose for\nwhich it was established. No more than two of the persons referred to in paragraphs 5\nto 7 above shall be seconded by the DIHK to fulfil the purposes for which the Dele-\ngation was established. Further personnel shall be employed locally.\n9. The salaries, wages and similar earnings of the persons referred to in paragraph 5\nabove who are seconded by or on behalf of the DIHK to fulfil the purposes for which\nthe representation of the Chambers of Commerce Abroad was established shall be\nsubject to taxation in accordance with the relevant applicable laws and regulations.\n10. The Government of the Republic of the Union of Myanmar shall grant persons working\nfor the Delegation on behalf of DIHK for the purposes specified in paragraph 2 above\nand their family members (spouse/registered partner and their children who are mi-\nnors or are undergoing training) an exemption from customs duties and similar\ncharges levied upon the import and re-export of personal property brought into the\nterritory of the host country within 12 months of their move there in accordance with\nthe applicable law.\n11. This Arrangement shall be concluded for an indefinite period; it may be terminated at\nany time in writing through diplomatic channels, giving one year’s notice.\n12. This Arrangement shall be without prejudice to any bilateral Agreements in force\nbetween the Republic of the Union of Myanmar and the Federal Republic of Germany.\n13. This Arrangement shall be concluded in the German and English languages, both\ntexts being equally authentic.\nIf the Government of the Republic of the Union of Myanmar agrees to the proposals of\nthe Government of the Federal Republic of Germany contained in paragraphs 1 to 13\nabove, this Note Verbale and the Note in reply thereto from the Ministry of Foreign Affairs\nof the Republic of the Union of Myanmar expressing the agreement of the Government of\nthe Republic of the Union of Myanmar shall constitute an Arrangement between the Gov-\nernment of the Federal Republic of Germany and the Government of the Republic of the\nUnion of Myanmar, which shall enter into force on the date of the Note in reply.\nThe Embassy of the Federal Republic of Germany avails itself of this opportunity to re-\nnew to the Ministry of Foreign Affairs of the Republic of the Union of Myanmar the assur-\nance of its high consideration.”\nGerman language version:\n„Die Botschaft der Bundesrepublik Deutschland beehrt sich, dem Ministerium für Aus-\nwärtige Angelegenheiten der Republik der Union Myanmar im Einklang mit den guten Be-\nziehungen zwischen beiden Ländern und in der Absicht, die wirtschaftlichen Beziehungen\nund insbesondere die Zusammenarbeit auf dem Gebiet des Handels und der Industrie\nzwischen beiden Ländern, vor allem im Bereich der klein- und mittelständischen Unter-\nnehmen, zu fördern, den Abschluss einer Vereinbarung zwischen der Regierung der Bun-\ndesrepublik Deutschland und der Regierung der Republik der Union Myanmar über die\nEinrichtung einer Delegation der deutschen Wirtschaft in Rangun vorzuschlagen, die fol-\ngenden Wortlaut haben soll:\n1. Mit dem Ziel, die wirtschaftliche Zusammenarbeit zwischen beiden Ländern wie vor-\ngenannt zu unterstützen, schlägt die Regierung der Bundesrepublik Deutschland der\nRegierung der Republik der Union Myanmar die Einrichtung einer Delegation der deut-\nschen Wirtschaft (im Folgenden als „Delegation“ bezeichnet) in Rangun nach den Be-\nstimmungen des myanmarischem Rechts vor. Die Regierung der Republik der Union\nMyanmar hat dem Vorschlag der Regierung der Bundesrepublik Deutschland zuge-\nstimmt. Die Delegation ist eine Vertretung des Deutschen Industrie- und Handelskam-\nmertags e. V. (DIHK). Sie wird die offizielle Bezeichnung „Delegation der Deutschen\nWirtschaft“ tragen.","Bundesgesetzblatt Jahrgang 2015 Teil II Nr. 34, ausgegeben zu Bonn am 18. Dezember 2015         1623\n2. Zweck der Delegation ist die Förderung der Handels- und Wirtschaftsbeziehungen\nzwischen Unternehmen, Organisationen und Gewerbetreibenden der Republik der\nUnion Myanmar und der Bundesrepublik Deutschland. Sie setzt sich für die Interessen\nder Wirtschaft beider Länder ein und fördert den Wirtschaftsverkehr in beide Richtun-\ngen. Die Delegation verfolgt keine Gewinnerzielungszwecke. Die Delegation wird sich\nüber die Zuwendung des Bundesministeriums für Wirtschaft und Technologie, Zu-\nschüsse des DIHK, Spenden und andere Einnahmen, die durch das geltende myan-\nmarische Recht zugelassen sind, finanzieren. Sie kann für ihre Dienstleistungen Ent-\ngelte zur Deckung der Kosten erheben.\n3. Die Delegation wird bei der zuständigen Stelle der Republik der Union Myanmar re-\ngistriert. Der Sitz der Delegation ist Rangun. Sie kann nach geltendem myanmari-\nschem Recht weitere Außenstellen im Hoheitsgebiet der Republik der Union Myanmar\neinrichten und unterhalten.\n4. Die Delegation wird im Bereich der Außenwirtschaftsförderung vom Bundesministe-\nrium für Wirtschaft und Technologie und dem DIHK finanziell unterstützt. Zahlungen,\ndie unmittelbar oder mittelbar von der Bundesrepublik Deutschland und dem DIHK\nan die Delegation zur Deckung der Kosten geleistet werden, sind in der Republik der\nUnion Myanmar von direkten Steuern befreit. Der Delegation ist gestattet, Konten in\nder Republik der Union Myanmar sowie in der Bundesrepublik Deutschland zu unter-\nhalten. Über den DIHK geleitete Bundeszuwendungen, die dem Unterhalt der Dele-\ngation dienen, können jederzeit, frei und ohne Beschränkung zum offiziellen Wech-\nselkurs auf die in der Republik der Union Myanmar unterhaltenen Konten der\nDelegation überwiesen werden.\n5. Personen, die in Abstimmung mit oder im Auftrag des DIHK zu den unter Nummer 2\ngenannten Zwecken bei der Delegation beschäftigt werden, sowie deren Familienan-\ngehörige (Ehe-/Lebenspartner und ihre minderjährigen oder in der Ausbildung befind-\nlichen Kinder) sind keine Angehörigen der diplomatischen oder konsularischen Ver-\ntretungen der Bundesrepublik Deutschland in der Republik der Union Myanmar. Sie\ngenießen nicht die Vorrechte und Immunitäten, die dem Personal solcher Vertretungen\ngewährt werden.\n6. Die zuständigen Behörden der Republik der Union Myanmar erteilen den unter Num-\nmer 5 genannten Personen bevorzugt einen Aufenthaltstitel im Rahmen der geltenden\nRechtsvorschriften und sonstigen Bestimmungen. Der Aufenthaltstitel beinhaltet das\nRecht auf mehrfache Ein- und Ausreise im Rahmen seiner Gültigkeitsdauer. Er wird\nnach Maßgabe des innerstaatlichen Rechts erstmalig längstens für fünf Jahre erteilt\nund kann danach verlängert werden. Vor der Ausreise aus Deutschland ist bei einer\ndiplomatischen oder berufskonsularischen Vertretung der Republik der Union Myan-\nmar ein Aufenthaltstitel in Form eines Visums einzuholen. Anträge auf Verlängerung\nder Gültigkeitsdauer können in Myanmar gestellt werden.\n7. Die unter Nummer 5 genannten Personen benötigen für die Tätigkeit bei der Delega-\ntion keine Arbeitserlaubnis.\n8. Die Anzahl der bei der Delegation Beschäftigten soll in einem angemessenen Verhält-\nnis zu dem Zweck stehen, dessen Erfüllung die Einrichtung der Delegation dient. Nicht\nmehr als zwei der unter den Nummern 5 bis 7 genannten Personen werden vom DIHK\nzur Erfüllung der Zwecke, denen die Einrichtung der Delegation dient, entsandt. Wei-\nteres Personal wird vor Ort eingestellt.\n9. Die steuerliche Behandlung der Gehälter, Löhne und ähnlichen Bezüge der unter\nNummer 5 genannten Personen, die vom DIHK oder im Auftrag des DIHK zur Erfüllung\nder Zwecke, denen die Einrichtung der Auslandshandelskammer dienen, entsandt\nsind, richtet sich nach den jeweils geltenden Gesetzen und sonstigen Vorschriften.\n10. Die Regierung der Republik der Union Myanmar gewährt denjenigen Personen und\nderen Familienangehörigen (Ehe-/Lebenspartner und ihre minderjährigen oder Aus-\nbildung befindlichen Kinder), die im Auftrag des DIHK zu den unter Nummer 2 ge-\nnannten Zwecken bei der Delegation beschäftigt sind, für Übersiedlungsgut, das in-\nnerhalb von 12 Monaten nach der Übersiedlung in das Hoheitsgebiet des Gastlandes\neingeführt wird, bei der Ein- und Wiederausfuhr die Befreiung von Zöllen und Abgaben\nmit gleicher Wirkung nach Maßgabe des geltenden Rechts.\n11. Diese Vereinbarung wird auf unbestimmte Zeit geschlossen; sie kann unter Einhaltung\neiner Frist von einem Jahr jederzeit auf diplomatischem Wege schriftlich gekündigt\nwerden.\n12. Diese Vereinbarung berührt keine im Verhältnis zwischen der Republik der Union My-\nanmar und der Bundesrepublik Deutschland geltenden zweiseitigen Abkommen.\n13. Diese Vereinbarung wird in deutscher und englischer Sprache geschlossen, wobei je-\nder Wortlaut gleichermaßen verbindlich ist.\nFalls sich die Regierung der Republik der Union Myanmar mit den unter Nummern 1\nbis 13 gemachten Vorschlägen der Regierung der Bundesrepublik Deutschland einver-\nstanden erklärt, werden diese Verbalnote und die das Einverständnis der Regierung der\nRepublik der Union Myanmar zum Ausdruck bringende Antwortnote des Ministeriums für","1624 Bundesgesetzblatt Jahrgang 2015 Teil II Nr. 34, ausgegeben zu Bonn am 18.
