August 2004\nDer Bundestag hat mit Zustimmung des Bundesrates das folgende Gesetz\nbeschlossen:\nArtikel 1\nDer in Rom am 17. November 1997 von der Konferenz der Ernährungs- und\nLandwirtschaftsorganisation der Vereinten Nationen angenommenen Fassung\ndes Internationalen Pflanzenschutzübereinkommens vom 6. Dezember 1951,\nrevidiert in Rom am 28. November 1979 (BGBl. 1985 II S. 982), wird zugestimmt.\nDas Übereinkommen in seiner Neufassung wird nachstehend mit einer\namtlichen deutschen Übersetzung veröffentlicht.\nArtikel 2\nDas Bundesministerium für Verbraucherschutz, Ernährung und Landwirt-\nschaft wird ermächtigt, durch Rechtsverordnung ohne Zustimmung des\nBundesrates\n1. Änderungen der Anlagen zu diesem Übereinkommen nach seinem Artikel XXI\nAbs. 6\nsowie durch Rechtsverordnung mit Zustimmung des Bundesrates\n2. Änderungen des Übereinkommens nach seinem Artikel XXI Abs. 4,\n3. Änderungen zu Artikel II und zu Artikel IV Abs. 2 des Übereinkommens nach\nseinem Artikel XXI Abs. 5,\ndie sich im Rahmen der Ziele des Übereinkommens halten, in Kraft zu setzen\nsowie\n4. die Anwendung des Übereinkommens gemäß seinem Artikel I Abs. 4 aus-\nzudehnen.\nArtikel 3\nÄnderung des Pflanzenschutzgesetzes\nDas Pflanzenschutzgesetz in der Fassung der Bekanntmachung vom 14. Mai\n1998 (BGBl. I S. 971, 1527, 3512), zuletzt geändert durch Artikel 149 der Ver-\nordnung vom 25. November 2003 (BGBl. I S. 2304), wird wie folgt geändert:\n1. § 2 wird wie folgt geändert:\na) Nummer 3 wird wie folgt gefasst:\n„Pflanzen: lebende Pflanzen und lebende Teile von Pflanzen einschließlich\nder Früchte und Samen;“.","Bundesgesetzblatt Jahrgang 2004 Teil II Nr. 26, ausgegeben zu Bonn am 25. August 2004 1155\nb) Nummer 4 wird wie folgt gefasst:\n„Pflanzenerzeugnisse: Erzeugnisse pflanzlichen Ursprungs, die nicht oder\nnur durch einfache Verfahren, wie Trocknen oder Zerkleinern, be- oder ver-\narbeitet worden sind, ausgenommen verarbeitetes Holz;“.\nc) In Nummer 9 werden\naa) in Buchstabe a und b jeweils vor dem Wort „Pflanzenerzeugnisse“ die\nWorte „lebende Teile von Pflanzen und“ sowie\nbb) in Buchstabe d vor dem Wort „Pflanzenerzeugnissen“ die Worte\n„lebende Teile von Pflanzen und“\neingefügt.\n2. Dem § 33 Abs. 4 wird folgender Satz angefügt:\n„Sie macht die nach Artikel X des Internationalen Pflanzenschutzüberein-\nkommens verabschiedeten Standards bekannt.“\nArtikel 4\nÄnderung der Pflanzenbeschauverordnung\nDie Pflanzenbeschauverordnung in der Fassung der Bekanntmachung vom\n3. April 2000 (BGBl. I S. 337), zuletzt geändert durch die Verordnung vom\n9. August 2004 (BGBl. I S. 2110), wird wie folgt geändert:\n1. In § 11 werden jeweils in den Sätzen 1 und 3 vor dem Wort „Pflanzen-\nerzeugnisse“ die Worte „lebende Teile von Pflanzen und“ eingefügt.\n2. In § 13f Abs.1 wird die Angabe „die in Anlage 4 Teil II Buchstabe B Nr. 2.1.1\nSpalte 1 und Buchstabe C Nr. 2.2 Spalte 1 aufgeführten Pflanzenerzeug-\nnisse“ durch die Angabe „die in Anlage 4 Teil II Buchstabe B Nr. 2.1.1\nSpalte 1 und Buchstabe C Nr. 2.2 Spalte 1 aufgeführten lebenden Teile von\nPflanzen“ ersetzt.\n3. In § 13j Abs. 1 Satz 1 wird das Wort „Pflanzenerzeugnisse“ jeweils durch die\nWorte „lebende Teile von Pflanzen“ ersetzt.\n4. In § 13k Abs. 1 Satz 1 und in § 13m Abs. 1 wird jeweils nach dem Wort\n„ausgenommen“ das Wort „Pflanzenerzeugnisse“ durch die Worte „lebende\nTeile von Pflanzen“ ersetzt.\n5. In Anlage 2 Abschnitt B und Anlage 3 Abschnitt B werden jeweils in der\nÜberschrift vor dem Wort „Pflanzenerzeugnisse“ die Worte „lebende Teile\nvon Pflanzen und“ eingefügt.\n6. In Anlage 4 Teil I Abschnitt B, C, D und E und in Anlage 4 Teil II Abschnitt B,\nC und E werden jeweils in Nummer 2 vor dem Wort „Pflanzenerzeugnisse“\ndie Worte „lebende Teile von Pflanzen und“ eingefügt.\n7. In Anlage 5 Teil I Abschnitt B und Teil II Abschnitt B werden jeweils vor dem\nWort „Pflanzenerzeugnisse“ ein Komma und die Worte „lebende Teile von\nPflanzen“ eingefügt.\n8. In Anlage 6 Teil II Abschnitt B und Teil III Abschnitt B werden jeweils in\nder Überschrift und jeweils in Nummer 2 vor dem Wort „Pflanzenerzeug-\nnisse“ die Worte „lebende Teile von Pflanzen und“ eingefügt.\n9. In Anlage 6 Teil IV Abschnitt A, B, C und D werden jeweils in Nummer 2 vor\ndem Wort „Pflanzenerzeugnisse“ die Worte „lebende Teile von Pflanzen\nund“ eingefügt.\n10.
